PRECISE Research Protocol

These Terms of Use govern your access to and use of the PRECISE Research website at precise-research.teachable.com (the “Site”). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. About These Terms

These Terms of Use (“Terms”) form a legally binding agreement between you and PRECISE Research (“we,” “us,” or “our”) regarding your access to and use of our Site.

These Terms apply to general use of the Site only. Separate agreements apply to:

Purchasing and using the PRECISE Research Protocol - governed by our End User License Agreement (EULA)

●

How we handle your personal data - governed by our Privacy Policy

In the event of a conflict between these Terms and the EULA or Privacy Policy regarding their respective subject matter, the EULA or Privacy Policy shall prevail.

2. Acceptance of Terms

By accessing, browsing, or using the Site, you confirm that you have read, understood, and agree to be bound by these Terms. If you are using the Site on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Eligibility

You must be at least 18 years old (or the age of majority in your country of residence) to use the Site. By using the Site, you represent and warrant that:

You have the legal capacity to enter into a binding agreement;

●

You are not located in, or a resident of, any country subject to comprehensive economic sanctions by Israel, the United States, the European Union, or the United Nations;

●

You are not listed on any sanctions list maintained by the foregoing authorities.

4. Acceptable Use

You agree to use the Site only for lawful purposes and in accordance with these Terms. You shall not:

Use the Site to transmit any malware, viruses, or other harmful code;

●

Attempt to gain unauthorized access to any part of the Site, our servers, or any related systems;

●

Use any automated means (such as bots, scrapers, or crawlers) to access, monitor, or copy any part of the Site without our prior written consent;

Interfere with or disrupt the Site or its servers;

●

Reproduce, duplicate, copy, sell, or resell any part of the Site, except as expressly permitted;

Use the Site to harass, abuse, or harm another person;

●

Impersonate any person or entity, or misrepresent your affiliation with any person or entity;

●

Bypass, remove, or attempt to circumvent any technical protection measure on the Site;

●

Use the Site for any commercial purpose other than purchasing or using a Product as permitted by the EULA.

5. Account Registration

Some features of the Site may require you to create an account. If you create an account, you agree to:

Provide accurate, current, and complete information;

●

Maintain the confidentiality of your login credentials;

●

Be solely responsible for all activities that occur under your account;

●

Notify us immediately of any unauthorized access to your account.

We reserve the right to suspend or terminate your account at our discretion if we believe you have violated these Terms.

6. Intellectual Property of the Site

All content on the Site - including but not limited to text, graphics, logos, the PRECISE name and brand, layouts, design elements, and software - is the property of PRECISE Research or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and view the Site for your personal, non-commercial use. You may not copy, reproduce, distribute, modify, or create derivative works from any Site content without our prior written permission.

Trademark Notice: “PRECISE Research” and the PRECISE logo are trademarks of PRECISE Research. Other trademarks displayed on the Site (including ChatGPT® and Claude™) are the property of their respective owners.

7. Purchases

Purchases of the PRECISE Research Protocol or any related products through the Site are subject to:

Our End User License Agreement (EULA), available at precise-research.teachable.com/p/end-user-license-agreement;

●

Our Privacy Policy, which governs how personal data is collected and processed in connection with purchases, available at precise-research.teachable.com/p/privacy;

●

Our Refund Policy, displayed on the Sales Page;

●

The terms of our payment processors (Stripe, PayPal) for payment-related matters.

By completing a purchase, you agree to all of these terms.

8. Privacy

Your privacy is important to us. Our collection and use of personal data through the Site is governed by our Privacy Policy, available at precise-research.teachable.com/p/privacy. Please review the Privacy Policy to understand how we collect, use, and protect your personal data.

9. Third-Party Services and AI Platforms

The Site is hosted by Teachable and may contain links or integrations to third-party services, including but not limited to:

We are not responsible for the content, availability, terms, or privacy practices of any third-party service. Your use of any third-party service is governed by that service’s own terms and privacy policy. We do not endorse and are not affiliated with any third-party AI platform.

9.1 AI Platform Trademark and Affiliation Disclaimer

ChatGPT® is a trademark of OpenAI, and Claude™ is a trademark of Anthropic, PBC. PRECISE Research is not affiliated with, endorsed by, sponsored by, or approved by OpenAI, Anthropic, or any other AI platform provider. References to these platforms are made solely for compatibility, identification, and descriptive purposes. PRECISE Research does not claim ownership of any third-party trademarks, models, platforms, or services.

10. Disclaimers

THE SITE AND ALL CONTENT ON IT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. You use the Site at your own risk.

Any informational content on the Site (including blog posts, FAQs, or product descriptions) is provided for general information only and does not constitute professional, legal, medical, financial, or other expert advice.

Any AI-related examples, workflows, or references on the Site are for informational purposes only and do not guarantee any particular AI output, result, accuracy, or performance.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

This includes, without limitation, damages for loss of profits, loss of revenue, loss of data, loss of goodwill, business interruption, or any other commercial or economic loss.

P R E C I S E

Our total cumulative liability arising under or relating to these Terms or your use of the Site shall not exceed USD $50 or the amount you paid us in the twelve (12) months preceding the claim, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless PRECISE Research and its affiliates, agents, and representatives from and against any claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

Your use of the Site;

Your violation of these Terms;

●

Your violation of any applicable law or third-party right.

13. Termination

We reserve the right to suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms.

Termination of access to the Site does not affect any rights or obligations under the EULA for products you have already purchased.

Provisions of these Terms that by their nature should survive termination - including Sections 6 (Intellectual Property), 10 (Disclaimers), 11 (Limitation of Liability), 12 (Indemnification), and 14 (Governing Law) - shall continue in full force and effect.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict-of-laws principles.

Except to the extent that mandatory consumer protection law provides otherwise and prohibits enforcement of this provision, the parties irrevocably agree that any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts of Tel Aviv-Jaffa, Israel.

Nothing in this Section limits any non-waivable rights granted to consumers under the mandatory consumer protection laws of their country of residence.

15. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, technology, legal requirements, or business operations. The “Effective Date” at the top indicates when these Terms were last updated.

Material changes will be communicated through the Site or by other reasonable means. Your continued use of the Site after such changes constitutes acceptance of the updated Terms.

16. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

These Terms, together with the EULA and Privacy Policy, constitute the entire agreement between you and PRECISE Research regarding your use of the Site, and supersede any prior agreements or understandings.
